For collection account there two modes of charges a) % mode where company bearings charges, b) Customer is the one charged

For Bulkpay; there is IOP charges where company is being charged for sending money to ex-net subscribers

  What is the limit for receiving and sending limit

No Limit collecting funds into the collection account, however Bulkpay the subscriber who is the end receiver has a limit based on the regulation

  Can I cash out through tigopesa wakala

No, you can request funds via bank or send it to bulkpay account

  Can a wrong transaction be re-corrected when wrong payment is made to a wrong beneficiary?

Definitely a company should write an email indicating transaction ID, amount transacted and number of a customer to whom wrong transaction has been performed and date of that transaction

  What is the use of VPN.

    Virtual Private Networks, allow users to securely access a private network and share data remotely through public networks. Much like a firewall protects your data on your computer, VPNs protect it online.

  How long it takes for a collected funds to be accessible for reimbursement.

 Collected funds settles every end of the day, thus will be accessible the next day. 

Terms & Condition:

These terms and conditions are issued by MIC Tanzania Limited and shall apply to all MIC Subscribers and or Customers of Collection and Disbursement Services provided by MIC through its mobile financial services (‘’Tigo Pesa’’). 

 

  1. DEFINITIONS AND INTERPRETATION: 

1.1. “Client” means a user of Collection and Disbursement Services offered by MIC; 

1.2. “Collection and Disbursement Services” means the ability to receive payment from or/and to make payments to Customers in electronic money. 

1.3. “Customer” shall mean a subscriber of MIC mobile financial services and includes the Client; 

1.4.  “MIC” means MIC Tanzania Limited; 

1.5. “Service” means the mobile money transfer services provided by MIC which the Client will use in order to collect funds from and/or effect payment of funds to Customers and may be used for other transactions as necessary; 

1.6.  “TIGO PESA” means the mobile financial services offered by MIC; 

1.7. In these terms and conditions (including the recitals), unless the context otherwise requires: 

1.7.1 Words denoting the singular shall include the plural and vice versa and reference to the masculine gender shall include a reference to the feminine gender and neuter and vice versa; 

1.7.2 References to clauses are references to the clauses of these terms and conditions; 

1.7.3 Headings to clauses are used for convenience only and shall not affect the construction and interpretation of these terms and conditions; 

 

  1. COMMENCEMENT AND TERM 

These terms and conditions shall apply to the Client immediately upon subscription to the Collection and Disbursement Services and shall continue in force until terminated by either Party in accordance with the terms contained herein. 

 

  1. CLIENT RESPONSIBILITIES 

3.1. Be responsible for the security (both physical and virtual) and the use of the Pay Bill Service; 

3.2. Be responsible for the equipment it installs or locates with previous authorization, in MIC’s network or systems. MIC shall not be responsible for the said equipment including damages, theft or robbery. 

3.3. Install Software programs and necessary equipment in its computer and communication systems for the detection and disabling of any virus that may contaminate computer equipment, software, terminals of any user and any kind of equipment installed in MIC’s network, that detects, prevents and/or isolate any activity designed to damage the information, equipment, files or software of MIC or of any of its users, according to the parameters established by MIC’s Technical Representative. 

3.4. Be responsible for any damage that it may cause to MIC when installing equipment, or once it has been installed, for any damage caused through the operation, repairs or maintenance of such equipment, or through or as consequence of the provision of the Collection and Disbursement Services. 

3.5. Implement and comply with any policies of MIC from time to time which address fraudulent or unlawful use of Tigo Pesa Services, the MIC Network, the Pay Bill Service, and/or any mobile device; and

3.6. Comply with any User Guide regarding or relating to the use of the Pay Bill Services. 

3.7. The Client shall be responsible for communicating to its customers the account number and how the customers should use the service through education and training. 

3.8. The Client shall provide customer support to its customers and provide separate and independent feedback to the customers on the status of their payments. 

3.9. The Client hereby undertakes to use the TIGO PESA services only for the purpose set out in the subscription form and shall not vary or modify the purpose without the prior written consent of MIC 

 

  1. MIC RESPONSIBILITY 

4.1. MIC shall charge the Customers for using the Service according to published tariffs 

4.2. MIC shall be responsible for setting up the Client on the pay bill website and provide the Client with access to access the pay bill website. 

4.3. MIC shall be responsible for the provision, operation and maintenance of the Service. 

4.4. MIC shall from time to time provide the Client with updates, changes, requirements, notices or any other information that MIC may feel from time to time is relevant to the Client. Such information may be provided as bulletins, email, published on the web or any other form. 

4.5. MIC shall use all reasonable endeavors to ensure consistent provision of the Service however due to nature of telecommunications services MIC does not guarantee a fault free Service.

4.6.  MIC shall not accept a transaction if: 

4.6.1. A Customer has not yet registered or been authorized or cleared to use Tigo Pesa Services or where such authorization has been withdrawn or suspended; 

4.6.2. The Transaction amount requested by the Customer is below the minimum or above the maximum amounts for Tigo Pesa transactions.

4.6.3. The Customer has exceeded the Tigo Pesa daily transaction limit 

 

  1. CHARGES 

5.1.  MIC shall from time to time publish applicable charges and tariffs. 

5.2. MIC reserves the right to vary the charges and tariffs of the Service at its discretion and without notice to the Customer. 

5.3.  All charges and tariffs on the Service are subject to applicable taxes. 

5.4. Where applicable, the charges shall be subject to foreign currency fluctuations. 

 

  1. SUSPENSION OF SERVICES 

6.1. MIC may at any time suspend the Service, in whole or in part and without liability under the following circumstances; 

6.1.1. should MIC be unable to provide the Service, in whole or in part, whether due to force majeure or otherwise through no fault of its own; or 

6.1.2. should a license or an agreement in terms of which MIC derives its rights and ability to provide the Service, be suspended, cancelled or terminated; or 

6.1.3. should such suspension of the Service be necessary in order to facilitate any repairs, modification, maintenance, improvement or remedial works in respect of the system; or 

6.1.4. should the Client fail to comply with these terms and conditions; or 

6.1.5. Should the Client use equipment that infringes or is alleged to infringe on the intellectual property rights of MIC or any third party.

6.2. Should the Service be suspended by reason of default of the Client, the Client shall be liable to MIC for any and all direct and indirect losses and damages suffered.

 

  1. TERMINATION 

7.1.  Termination for Breach 

Where a Party commits a breach of any obligation imposed on it in these terms and conditions (hereinafter the “Defaulting Party”), and fails to remedy such breach within a period of 30 (thirty) days from the date on which written notice is given to the Defaulting Party by the other Party (hereinafter the “Aggrieved Party”) requiring the Defaulting Party to remedy the breach, then the Aggrieved Party shall be entitled to terminate the Services on the expiry of such written notice and the Aggrieved Party shall be entitled to hold the Defaulting Party liable in damages as a result of such termination. 

7.2. Notwithstanding the generality of the foregoing, MIC may terminate the Services immediately if: 

7.2.1. The Client uses or is suspected of using the TIGO PESA Service in furtherance of any unlawful or criminal activity, including without limitation, tax evasion, money laundering or the funding of terrorism activities; 

7.2.2. It becoming evident that the business relationship envisaged herein is not commercially and/or operationally viable to MIC due to intermittent use of the Service by the Client.

7.2.3. the Service remaining idle for a period of three months 

7.3. The termination of the Services shall be without prejudice to all accrued rights and obligations of the Parties. 

7.4.  The client utilizes the service outside its permissible purpose.

 

  1. PRIVACY STATEMENT 

8.1. MIC and all its associated companies are committed to respecting the privacy of the Customer’s personal data. To demonstrate MIC’s commitment, MIC has created this Privacy Statement in order to communicate its intent to provide effective processes for the appropriate handling of private information and to comply with applicable legislation that governs the authentication, protection and disclosure of personal information. 

8.2. MIC has implemented technology, policies and processes aimed at protecting the confidentiality, integrity and availability of the Customer’s personal information. MIC shall update and refine these measures on an ongoing basis. MIC assumes no responsibility or liability of any nature whatsoever for the interception or loss of personal information beyond MIC’s control. 

8.3. MIC does not distribute any of the Customer’s personal information to third parties unless it’s requested by the Customer or it’s legally required to do so by a statute. For avoidance of doubt and clarity,
